"Part of the 1%'s strategy is to shut down our legal options," says Markie Miller of Toledoans for Safe Water (TSW), the group behind the LEBOR initiative.  "As long as there is a Lake to protect, we won't be going anywhere."
 
To justify his decision, Zouhary wrote that LEBOR would "injure" the two plaintiffs - State of Ohio and Drewes Farms.  In doing so, he ironically explained how both plaintiffs would violate LEBOR, and thus harm the lake.

Ohio and Pennsylvania History

Data obtained from ODNR for brine from oil and gas production, demonstrates brine spread on Ohio's roads includes numerous substances known to be harmful to human health and the environment, including: radium, arsenic, lead, selenium, benzene, boron, toluene, xylene, hexane, ethylbenzene, trimethylbenzene, butanone, acetone, methylacetate, isopropylbenzene, and other volatile organic compounds.
 
Complaints discovered during a review of public records from the Ohio EPA suggest that untreated brine spread on Ohio's roads has contaminated Ohio's surface waters.  If the brine spreading results in the discharge of a pollutant into a water of the United States (remember all of these terms are very broadly defined under current law) without a permit to do so, then that discharge is in violation of the federal Clean Water Act.

AquaSalina owner has his day at Medina city council
 
 
Michael Mansberry, owner of AquaSalina, at Medina city council.
 
Years ago, he sued MADION (Mothers Against Drilling In Our Neighborhoods) for deformation. Now he is presenting his science to Medina city council to plea for them to continue using AquaSalina on their township roads for dust and ice control.
 
Our science, produced by ODNR, shows that AquaSalina averages about 300 times the EPA drinking water limit for combined radium-226/228. This translates to more than 20 times the EPA environmental discharge limit! A bottle of AquaSalina, taken directly off the shelf of a hardware store in Northern Ohio, tested at 498 times the drinking water limit for combined radium-226/228!
 
According to Kathie Jones of 'Sustainable Medina County', the council president indicated to her that they do not plan on using the product on their roads.
 
PLEASE CONTACT YOUR STATE LEGISLATORS AND DEMAND THAT ALL OIL AND GAS WASTE BRINES ARE BANNED FROM BEING DISCHARGED INTO THE SURFACE ENVIRONMENT.
