 In what will likely be the final case filing before the hearing, Judge Zouhary laid out in writing eight legal questions he wants lawyers from both sides to be prepared to answer in court.
 
They include such questions as to whether they believe LEBOR could be applied to polluters located outside of Toledo; whether the state of Ohio meets the "injury-in-fact" requirement for standing; whether or not the case could proceed if the state has standing but Drewes Farm does not, and other legal matters.
 
One of his questions ofr attorneys poses this: "LEBOR became part of Toledo's charter through ballot initiative, not legislative enactment.  Does this circumstance affect standing or the merits?"

The Buckeye Environmental Network “Brine Fact Sheet” is attached to this newsletter email.  This is a compilation of results from ODNR-sanctioned testing of conventional oil and gas production brines in Ohio.  This testing has been done over the past two years, and now shows how the levels of radionuclides, radium in particular, water-soluble, bone-seeking, and with a half-life of 1600 years, are hundreds of times higher than previously shown to the public.  Road spreading of these brines on Ohio road must be banned, as they are highly-toxic and carcinogenic.  As geologist/consultant Dr. Julie Weatherington-Rice says, “they are the gift that keeps on giving”.

Dr. Randi Pokladnik, a local retired environmental scientist/research chemist spoke about the impacts that plastics - especially single-use plastics - and petrochemicals have on health, and the cracker plant's potential impact on the Ohio River. Upon her introduction to the crowd, Pokladnik quickly noted how disappointing it was not to have one local politician in attendance.

The Schweitzers' property is surrounded by highly-pressurized under ground injection wells that store wastewater from oil and gas drilling.  After tests confirmed that the saltwater had a similar chemical profile to wastewater dumped in the area, the Oklahoma Corporation Commission shut down eight disposal wells and reduced pumping rates for several more in November.  The agency, which regulates the oil and gas industry in the state, has also banned new wells in a 14,000-square-mile area near the Schweitzers' field.
